The right exists automatically
A woman entitled to inherit acquires her share at the moment of the deceased death. No family consent is required and no one has the authority to allocate her a lesser share.
Forced relinquishment
A relinquishment deed signed under pressure, without independent advice or without consideration, can be challenged. Courts examine the circumstances closely where a woman has given up a valuable inheritance for nothing.
Exclusion from mutation
Where an inheritance mutation records only the male heirs, the remedy is a suit for declaration and possession together with cancellation of the mutation. Plead the date of knowledge, since limitation runs from then.
Dower and dowry are separate
Dower is a debt owed by the husband and is enforceable like any other debt. Dowry articles remain the property of the wife. Neither is affected by the dissolution of the marriage, save as the court orders on khula.
Evidence to gather
Obtain the death certificate, the succession certificate or inheritance mutation, the jamabandi showing the recorded shares, and any relinquishment deed relied upon by the other side.
